Terms and Conditions for SecretLit

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the SecretLit website and services ("Service") provided by Isaac Petrov ("I", "me", "my"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Account Registration and Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and purchase credits. You are responsible for providing an accurate email address and for maintaining the confidentiality of your account password. All activities that occur under your account are your responsibility.

3. Acceptable Use Policy

You agree not to use the Service to create, generate, prompt, or distribute any content that is illegal, harassing, hateful, defamatory, or infringes upon the rights of any third party. You are solely responsible for the prompts you write. While the Service is designed to be private, we reserve the right to suspend or terminate any account that we have reason to believe is being used to facilitate illegal activities or violate these terms.

4. Content, Copyright, and the Nature of AI Generation

SecretLit is a tool for creating personalized literature through the use of third-party generative artificial intelligence models. You acknowledge and agree to the following:

• AI-Generated Content: All text and images within your stories are generated by AI. This content is provided on an "as-is" and "as-available" basis. We do not claim authorship over AI-generated content and make no warranties regarding its accuracy, originality, or fitness for any purpose.
• Your Role as Curator: You are the curator of your story. The Service provides tools to guide, regenerate, and edit content. If you are unsatisfied with a generated output, your sole recourse is to use these tools to create a new output.
• Ownership and Use: You may use the stories you create for your own personal, non-commercial purposes. The legal landscape regarding copyright of AI-generated works is complex and evolving. We make no claim of copyright ownership over the final composition of your story, nor can we guarantee that you will be able to enforce a copyright claim over it.
• Potential for Bias and Inaccuracy: You acknowledge that AI models may produce content that is factually incorrect, repetitive, or reflects societal biases from their training data. We are not responsible for such outputs.

5. Privacy Policy

Your privacy is the cornerstone of SecretLit. This section details how we handle your data.

5.1. Data We Collect

We collect the absolute minimum data necessary to operate the Service:

• Account Data: Your email address for authentication and communication.
• Financial Data: A history of your credit purchases and current balance. We do not process or store your full credit card information; this is handled securely by our third-party payment processor.
• Client-Side Story Data: The full text and images of your stories are stored **only** on your local device in your browser's IndexedDB storage. We do not have a copy.
• Ephemeral Story Data in Transit: To generate new content, the most recent parts of your story are sent through our secure server to our AI partners. We do not log, store, or retain this data. It is deleted from our server's memory immediately after the request is processed.

5.2. How We Use Your Data

• To provide and maintain the Service.
• To process your credit purchases.
• To communicate with you about your account or significant service updates.

5.3. Data Sharing

We do not sell your personal data. We only share it when technically necessary:

• With our AI partners to generate content.
• With our payment processors to handle transactions.

5.4. Your Rights and Data Deletion

You have the right to access or delete your account information at any time. Deleting your account will permanently remove your email and financial history from our active systems. Since your story data is stored on your device, deleting your account does not delete your stories from your browser, but it makes it impossible to access them.

6. Credits, Payments, and Refunds

• Credit System: The Service operates on a pre-paid credit system. Credits are purchased in advance and are deducted from your account balance as you generate text and images.
• Transparency: Your current credit balance is always visible within the application. The cost of each generation may vary based on the AI model and complexity, and is used to cover the costs from our AI partners and our operational margins.
• All Sales Final: All purchases of credits are final and strictly non-refundable.
• Account Dormancy and Credit Forfeiture: If an account shows no login activity for a continuous period of twelve (12) months, it will be considered dormant. Any remaining credit balance in a dormant account will be forfeited to cover long-term account maintenance costs. We will send a warning to your registered email address at least 30 days before your account is declared dormant.

7. Service Availability and Disclaimers

The Service is provided "as-is" and "as available." It relies on third-party AI providers, whose services may experience outages or changes beyond our control. We do not guarantee uninterrupted, error-free service. In the event of an outage, your credit balance will remain safe. However, we are not responsible for any data loss. You are solely responsible for backing up your stories, a feature which is provided within the application.

8. Limitation of Liability and Indemnification

To the maximum extent permitted by law, SecretLit and its creator, Isaac Petrov, shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service. Our total liability for any claim shall be limited to the amount you have paid for credits in the last 12 months, or one hundred euros (€100), whichever is less. You agree to indemnify and hold us harmless from any claims arising from your violation of these terms.

9. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Amsterdam.

10. Changes to These Terms

The world of AI is evolving rapidly. We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or an in-app notification. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
